Improve Your Space - Terms and Conditions for Estimates
1. Definitions
1.1. “Company” refers to IYS (Improve Your Space), ABN 18 588 788 695, a home organising business based in New South Wales, Australia, providing services including the supply and installation of shelving and furniture.
1.2. “Customer” refers to the individual or entity receiving an estimate and/or services from the Company.
1.3. “Estimate” refers to the preliminary cost projection provided to the Customer for the requested services and products.
2. Scope of Estimate
2.1. The Estimate provided is based on the initial consultation and the information available at the time.
2.2. The Estimate includes costs for the supply and installation of specified shelving and furniture.
2.3. The Estimate does not include unforeseen expenses, additional work requested by the Customer, or changes in the scope of work after the initial Estimate.
3. Validity of Estimate
3.1. The Estimate is valid for a period of 7 days from the date of issuance.
3.2. After 7 days, the Estimate may be subject to revision based on changes in costs, availability of materials, or other factors.
4. Changes to Estimate
4.1. The Company reserves the right to adjust the Estimate if there are changes in the Customer’s requirements, design modifications, or any additional requests.
4.2. The Company will notify the Customer of any changes to the Estimate as soon as possible, and a revised Estimate will be provided for approval.
5. Acceptance of Estimate
5.1. Acceptance of the Estimate must be provided in writing by the Customer.
5.2. Payment in full of the total Estimate by the Customer will be considered as acceptance of these terms and conditions.
6. Payment Terms
6.1. The total amount of the Estimate is required to be paid in full upon acceptance.
6.2. Payments must be made in accordance with the payment schedule specified in the Estimate.
6.3. Work will commence only after full payment has been received.
7. Supply of Materials
7.1. The Company will make all reasonable efforts to supply the materials as specified in the Estimate.
7.2. If any specified materials are out of stock or unavailable, the Company will inform the Customer and offer suitable alternatives.
7.3. Any changes in materials may result in a revision of the Estimate, and the Customer will be informed of any cost differences.
8. Installation and Delivery
8.1. The Company will endeavour to complete the installation within the time frame agreed upon with the Customer.
8.2. Any delays due to unforeseen circumstances, such as weather conditions or supplier delays, will be communicated to the Customer promptly.
9. Liability
9.1. The Company will take all necessary precautions to ensure the safety and quality of the work performed.
9.2. The Company is not liable for any damage or loss caused by factors beyond its control, including but not limited to natural disasters, acts of vandalism, misuse, or any other pre-existing conditions at the Customer’s premises.
9.3. The Customer is responsible for securing any necessary permits or approvals required for the installation work.
10. Warranty
10.1. The Company provides a 1 year warranty on all installation work and materials supplied, commencing from the date of completion.
10.2. The warranty does not cover normal wear and tear, misuse, or damage caused by external factors.
11. Cancellation
11.1. The Customer may cancel the project prior to the commencement of work with no penalty.
11.2. If the project is cancelled after work has commenced, the Customer will be liable for the cost of materials and labour already incurred.
12. Governing Law
12.1. These terms and conditions are governed by the laws of New South Wales, Australia.
12.2. Any disputes arising under these terms and conditions will be resolved in accordance with the laws of New South Wales.
13. Acceptance of Terms
13.1. By accepting the Estimate, the Customer agrees to these terms and conditions in their entirety.
13.2. Payment in full of the total Estimate by the Customer will be considered as acceptance of these terms and conditions.
